We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used.

We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorised access, disclosure, copying, use or modification.

We don’t share any personally identifying information publicly or with third-parties, except when required to by law.

We can irrevocably erase all your personal data if you request us to do that.

Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies.

You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services.

Please read these Terms of Service and Payment Policy (“Terms”, “Terms of Service”, "Payment Policy") carefully before using the https://activeinafrica.com/ website (the “Service”) operated by Active in Africa (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Payment Policy. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms and Payment Policy. If you disagree with any part of the terms, then you may not access the Service.

Promotion of third party holidays

Active in Africa promotes the services of other third party active holidays as well as our own. Should you make a booking for a third party holiday, you will be subject to the terms and conditions of said party. Active in Africa is not liable for the services provided by the third party.

Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by Active in Africa.

Active in Africa has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Active in Africa shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Payment Policy

To reserve a spot on a specified holiday, a non-refundable booking fee of $400 is required upon booking. After a confirmation has been emailed to you OR an Active in Africa representative calls you to confirm your reservation, a courtesy hold requires payment within 3 working days to secure the reservation. Full payment (the balance) must be made within 60 days of the holiday start date. Prices are based per person. Prices DO NOT include flights. Clients must have adequate travel insurance to cover all activities listed.

Travel Insurance

Please note, even if you have private health insurance in your respective Country of residence, it is unlikely that this insurance will cover overseas trips such as the holidays offered by Active in Africa. It is your responsibility to organize suitable travel and health insurance. Although we strongly encourage you to do so, you acknowledge that Active in Africa is not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially, or otherwise.

Active in Africa Cancellations Definitions

“Cancellation” is defined as not attending your scheduled holiday, including postponing or rescheduling. “You” refers to the guest booking an Active in Africa holiday. “We” refers to Active in Africa. It is your responsibility to read and understand our cancellation policy before making a reservation. Naturally, no one books with the intention of canceling or postponing their holiday, but unexpected things do happen, so please consider purchasing travel cancellation insurance.

Travel Cancellation Insurance

Depending on the policy and conditions, travel cancellation insurance may pay for some or all cancellation fees. Strictly for informational purposes and not to be relied upon, with most agencies, this type of insurance must be purchased within 14 days of making your reservation to optimize your level of protection.

Guest Cancellation Policy

Depending on when you cancel, cancellation fees may apply. Fees are determined by the following schedule (“the Cancellation fee schedule”):

If you cancel 30 days or more before your holiday start date, you will be refunded (less any bank or exchange fees) the full holiday amount (minus your $400 booking fee); If you cancel 14 days or less before your holiday start date, you will forfeit your entire payment. Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason.

We do not offer credit for arriving late or leaving early. A guest can change to another holiday 30 days or before your holiday start date for a fee of $250. Please note the holiday must have availability.

Active in Africa Cancellation Policy

If Active in Africa must cancel for any reason, you’re entitled to transfer your full holiday payment to another holiday (either scheduled or at some future time). Alternatively, you may request a refund of your applicable payment, which will be accommodated insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your holiday.

Active in Africa is not responsible for your expenses incurred in preparation for any canceled holiday such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip.

If an event is needed to be postponed due to circumstances out of our control, you will be provided with your choice of a place on the new event date or a 100% credit voucher to use on any of our holidays.

Passports, Visas & Documents

It is the responsibility of each participant to obtain a valid passport, visa(s), and necessary certificates for any country to be visited in connection with an Active in Africa holiday.

Third Parties

Active in Africa holds no responsibility for the actions or omissions of third parties or independent contractors, including in the event that they modify the nature of a service on a holiday as compared with the advertised nature of the service.

General Waiver

You acknowledge that during a holiday you participate voluntarily in any and all activities arranged by the holiday organizers and, insofar as legally permissible, surrender your right to any cause of action against Active in Africa arising from any loss or damage to person or property that occurs during a holiday.

Photo/Video Release Form

I hereby grant to Active in Africa the absolute and irrevocable right and unrestricted permission to use photographic portraits/images/videos in which I feature that are taken during the course of the holiday to use/republish/copyright, etc. for commercial use in association with Active in Africa’s business. I hereby release and discharge Active in Africa from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.
